Trustody Terms of Service

Trustody is a relationship-based discovery and networking platform designed to help people build, navigate, and share trusted professional and community connections.

Trustody allows users to:

• Create and share professional and personal networks
• Discover people, professionals, organizations, and services
• Exchange recommendations and referrals
• Explore relationship-based trust signals
• Find relevant connections based on shared networks, proximity, interests, specialties, responsiveness, and other contextual factors
• Learn about professionals and services through community-informed insights

These Terms of Service ("Terms") govern your use of the Trustody platform, website, applications, tools, communications, and related services (collectively, the "Services").

By using Trustody, you agree to these Terms.

If you do not agree, do not use the Services.

Trustody is an informational and relationship-based networking platform.

Trustody is designed to help users discover and navigate professional and community relationships using informational signals, recommendations, and network connections.

Trustody does not certify, endorse, guarantee, supervise, monitor, or independently validate the trustworthiness, qualifications, ethics, competence, licensing status, or suitability of users, professionals, organizations, or services listed on the platform.

Trustody is not:

• A law firm
• A healthcare provider
• A fiduciary institution
• A financial advisory firm
• A licensing authority
• A credentialing organization
• A professional regulatory body
• A background screening service

Profiles, recommendations, endorsements, relationship information, and Trustody Scores are primarily generated or informed by users, providers, public information, community participants, network relationships, and automated platform systems.

Users are solely responsible for independently evaluating professionals, services, organizations, recommendations, and relationships.

Trustody may display or organize information using various relationship-based and informational signals ("Trust Signals"), including informational scores, recommendations, network insights, and automated organizational features.

Trustody Scores and Trust Signals may incorporate or reflect multiple contextual and informational factors, including but not limited to:

• Shared connections
• Community recommendations
• Mutual relationships
• User interactions
• Responsiveness
• Profile completeness
• Areas of focus or specialization
• Geographic proximity
• Community participation
• Referral activity
• Network relevance
• User preferences
• Informational categorization
• Other contextual or automated factors

Trustody Scores and Trust Signals are intended solely to help users navigate relationships and discover potentially relevant people, professionals, organizations, or services.

Trustody Scores are informational and algorithmic indicators only. They are designed to reflect relationship-based and contextual platform signals and do not represent objective measurements of professional competence, ethics, safety, trustworthiness, or quality.

Trustody Scores and Trust Signals do not constitute:

• Verification
• Certification
• Endorsement
• Ranking of professional competence
• Guarantees of safety or quality
• Guarantees of outcomes
• Guarantees of trustworthiness

Trustody Scores and Trust Signals may change over time and may be influenced by evolving platform data, network relationships, profile activity, recommendations, responsiveness, relevance, user interactions, or other contextual and automated factors.

Trustody does not disclose all algorithmic weighting, scoring methodologies, or platform logic and reserves the right to modify scoring systems, informational indicators, recommendation systems, and organizational methodologies at any time.

Trustody does not represent that any user, provider, or organization is safe, qualified, ethical, licensed, insured, competent, trustworthy, or appropriate for your particular situation.

Users should independently verify all important information.

Trustody may display relationship-based indicators, badges, or signals intended to help users understand network relationships and community familiarity.

A "Connected" indicator means that a verified Trustody participant reports direct familiarity, relationship, collaboration, referral history, or experience with the individual, organization, or service.

Connected indicators and relationship signals are informational only and do not represent:

• Professional certification
• Licensing validation
• Competency review
• Safety screening
• Endorsement by Trustody
• Guarantees of trustworthiness or professional quality

Trustody does not independently validate the underlying relationship experiences represented by Connected indicators.

Use of Trustody does not create:

• An attorney-client relationship
• A fiduciary relationship
• A doctor-patient relationship
• A therapist-patient relationship
• A financial advisor-client relationship
• A guardian relationship
• Any other professional relationship with Trustody

Trustody does not provide legal, medical, financial, fiduciary, tax, mental health, or professional advice.

Any professional relationship is solely between users and the independent third-party professionals or organizations they choose to contact.

Users are responsible for:

• Evaluating whether a provider or service is appropriate for their needs
• Independently verifying credentials, licenses, insurance, and qualifications where relevant
• Exercising judgment when relying on recommendations or referrals
• Protecting their own confidential and sensitive information
• Complying with applicable laws

Trustody encourages users to conduct their own due diligence before engaging any professional or service.

Users may create profiles, recommendations, endorsements, comments, network connections, and other content ("User Content").

You are responsible for the accuracy and legality of any information you submit.

By posting content on Trustody, you represent that:

• The information is truthful to the best of your knowledge
• You have the right to share the content
• The content does not violate another person's rights or applicable law

Trustody does not guarantee the accuracy, completeness, or reliability of User Content.

Trustody reserves the right to remove or moderate content at its discretion.

At this time, Trustody does not independently verify:

• Professional licenses
• Certifications
• Insurance coverage
• Educational credentials
• Professional standing
• Criminal background history
• Regulatory compliance
• Professional competence
• Ethical conduct

Users should not assume that any profile, recommendation, endorsement, badge, or platform presence has been independently reviewed or approved by Trustody.

Where Trustody references "verified" participants or accounts, verification refers only to account participation, identity or account authenticity where applicable, or network participation.

If Trustody introduces verification features in the future, those features may be subject to separate terms and disclosures.

Trustody allows users to create, share, and explore relationship-based networks and recommendations.

Recommendations reflect the opinions, experiences, relationships, or perspectives of individual users and do not necessarily reflect the views of Trustody.

Trustody does not guarantee:

• The accuracy of recommendations
• The quality of services
• The outcomes of professional engagements
• Compatibility between users and providers

Users are solely responsible for determining whether to rely on recommendations or engage any professional or organization.

Trustody may use artificial intelligence ("AI"), automated systems, and algorithmic tools to support platform functionality, including:

• Search organization
• Profile categorization
• Recommendations
• Relationship mapping
• Relevance ranking
• Informational summaries
• Network insights
• User experience improvements

AI-generated or automated outputs are intended for informational purposes only and may contain inaccuracies, incomplete information, or outdated information.

Trustody does not guarantee the accuracy or reliability of AI-generated content or automated recommendations.

At this time, Trustody does not use confidential user-submitted information to train public AI models.

Trustody intends to use controlled systems designed to limit unnecessary external exposure of user data.

However, no electronic platform can guarantee absolute privacy or security.

Users should avoid sharing highly sensitive, confidential, legal, medical, financial, or personal information through the platform unless necessary.

Trustody reserves the right to modify or expand AI and automated features over time.

Trustody is intended as a networking and discovery platform, not a secure document repository or confidential communications system.

Users should avoid uploading or transmitting highly sensitive information, including:

• Estate planning documents
• Medical records
• Financial account information
• Social Security numbers
• Government identification documents
• Protected health information
• Confidential legal communications

Users acknowledge that internet communications are never completely secure.

Trustody is not intended to function as:

• A HIPAA-compliant medical platform
• A legal document vault
• A fiduciary accounting system
• A secure attorney-client communication portal

Trustody may allow communication between users.

Users are solely responsible for their interactions with other users and providers.

Trustody does not monitor or guarantee:

• The accuracy of communications
• Professional conduct
• Confidentiality between users
• The legitimacy of users or providers
• The safety of interactions

Users should exercise caution and judgment when communicating with others.

You agree not to:

• Use Trustody for unlawful purposes
• Misrepresent your identity, qualifications, or affiliations
• Post false or misleading information
• Harass, threaten, or exploit others
• Engage in fraud or deceptive conduct
• Attempt to manipulate recommendations or relationship signals
• Upload malicious software or harmful content
• Scrape or copy platform data without authorization
• Violate the privacy rights of others

Trustody may suspend or terminate accounts that violate these Terms.

The Trustody platform, software, branding, logos, design elements, and related materials are owned by Trustody or its licensors.

You may not copy, reproduce, distribute, reverse engineer, or commercially exploit Trustody materials without permission.

Trustody does not guarantee uninterrupted access to the Services.

The platform may experience downtime, technical issues, delays, interruptions, or data loss.

Trustody may modify, suspend, or discontinue features at any time.

At this time, Trustody does not charge users referral fees for recommendations made through the platform.

Trustody does not currently operate as a paid referral marketplace.

Trustody may introduce paid services, subscriptions, advertising, premium features, sponsorships, or other monetization features in the future.

Any future paid features may be governed by additional terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTODY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY
• RELIABILITY
• AVAILABILITY
• SECURITY
• NON-INFRINGEMENT

Trustody does not guarantee:

• The accuracy of platform information
• The quality of professionals or services
• The reliability of recommendations
• The validity of Trust Signals
• The accuracy or meaning of Trustody Scores
• The safety of users or providers
• Any specific outcomes or results

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTODY SHALL NOT BE LIABLE FOR:

• Indirect damages
• Consequential damages
• Emotional distress
• Lost profits
• Loss of data
• Professional malpractice
• Provider misconduct
• Fraud by third parties
• Decisions made based on platform information
• Reliance on recommendations, Trust Signals, Connected indicators, or Trustody Scores

TRUSTODY'S TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT PAID BY YOU TO TRUSTODY, IF ANY, DURING THE PRIOR 12 MONTHS.

Some jurisdictions may not allow certain limitations of liability.

You agree to indemnify and hold harmless Trustody and its affiliates, officers, employees, contractors, and agents from claims or liabilities arising from:

• Your use of the Services
• Your User Content
• Your interactions with others
• Your violation of these Terms
• Your violation of applicable law

Before initiating legal proceedings, parties agree to attempt informal resolution in good faith.

Except where prohibited by law, disputes arising from these Terms may be resolved through binding arbitration in California.

Users agree to resolve disputes individually and waive participation in class actions where permitted by law.

These Terms are governed by the laws of the State of California.

Trustody may update the Services or these Terms from time to time.

Updated Terms will become effective upon posting.

Continued use of Trustody constitutes acceptance of revised Terms.

Trustody may suspend or terminate access to the platform at its discretion, including for violations of these Terms or conduct that may harm users or the platform.

Users may stop using the platform at any time.
